1. General Provisions

1.1. This Privacy Policy describes how AV STYLE (hereinafter also referred to as the “Data Controller”) acquires, processes, and stores personal data obtained by the online store https://avstyle.lv from its customers and persons visiting the website (hereinafter referred to as the “Data Subject” or “You”).
1.2. Personal data is any information relating to an identified or identifiable natural person, i.e., the Data Subject. Processing is any operation performed on personal data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.
1.3. The Data Controller complies with the data processing principles specified in legislation and can demonstrate that personal data is processed in accordance with applicable laws.

2. Acquisition, Processing, and Storage of Personal Data

2.1. The Data Controller acquires, processes, and stores personally identifiable information primarily through the online store website and email.
2.2. By visiting and using the services provided in the online store, You agree that any information provided will be used and managed in accordance with the purposes set out in this Privacy Policy.
2.3. The Data Subject is responsible for ensuring that the submitted personal data is correct, precise, and complete. The deliberate provision of false information is considered a violation of our Privacy Policy. The Data Subject is obligated to immediately notify the Data Controller of any changes to the submitted personal data.
2.4. The Data Controller is not responsible for damages caused to the Data Subject or third parties resulting from falsely submitted personal data.

3. Processing of Customers' Personal Data

3.1. The Data Controller may process the following personal data:

  • Contact Information: First name, last name, delivery address, billing address, phone number, email address.

  • Financial and Transaction Data: Payment card and account information, transaction details, purchased/viewed items, purchase amount, and payment confirmation.

  • Account Information: Username, password, preferences, and settings (if you create a user account).

  • Communication Data: Any information you provide when contacting customer support or leaving reviews.

  • Device and Usage Data: IP address, browser type, network connection, device information, as well as information on how you navigate the website (using cookies and other technologies).

3.2. In addition to the above, the Data Controller has the right to verify the accuracy of the submitted data using publicly available registers.

3.3. The legal basis for processing personal data is points (a), (b), (c), and (f) of Article 6(1) of the General Data Protection Regulation (GDPR):

  • a) The Data Subject has given consent to the processing of their personal data for one or more specific purposes;

  • b) Processing is necessary for the performance of a contract or to take steps at the request of the Data Subject prior to entering into a contract;

  • c) Processing is necessary for compliance with a legal obligation to which the Data Controller is subject;

  • f) Processing is necessary for the purposes of the legitimate interests pursued by the Data Controller or by a third party (e.g., fraud prevention, ensuring security, improving services).

3.4. The Data Controller stores and processes the Data Subject's personal data as long as at least one of the following criteria is met:

  • 3.4.1. Personal data is necessary for the purposes for which it was received;

  • 3.4.2. As long as the Data Controller and/or the Data Subject can exercise their legitimate interests (e.g., submit objections, bring or pursue legal action) in accordance with procedures specified by external regulations;

  • 3.4.3. As long as there is a legal obligation to store the data (e.g., under the Law on Accounting);

  • 3.4.4. As long as the Data Subject's consent to the respective personal data processing remains valid, provided no other lawful basis for processing exists.

Upon the termination of the conditions mentioned in this point, the personal data storage period expires, and all relevant data is permanently deleted or anonymized.

3.5. Transfer of Data to Third Parties and Processors:

  • To ensure the operation of the e-store, the website is hosted on the Shopify platform, which processes your data on our behalf and in accordance with its security standards.

  • Payment processing is provided by the payment platform makecommerce.lv; therefore, our company transfers personal data necessary for payment execution to the platform owner, Maksekeskus AS.

  • To fulfill obligations (e.g., to deliver goods or provide accounting services), we may transfer data to cooperation partners—courier services, IT and analytics service providers, etc.

  • Upon request, personal data may be disclosed to state and law enforcement authorities to defend our legal interests.

3.6. When processing and storing personal data, the Data Controller implements organizational and technical measures to ensure the protection of personal data against accidental or unlawful destruction, alteration, disclosure, or any other unlawful processing.

4. Rights of the Data Subject

4.1. In accordance with the General Data Protection Regulation and the laws of the Republic of Latvia, You have the right to:

  • 4.1.1. Access your personal data, receive information about its processing, request a copy of your personal data in an electronic format, and exercise the right to data portability to another controller;

  • 4.1.2. Request the correction of incorrect, inaccurate, or incomplete personal data;

  • 4.1.3. Delete your personal data ("the right to be forgotten"), except in cases where retention is required by law;

  • 4.1.4. Withdraw your previously given consent to personal data processing;

  • 4.1.5. Restrict or object to the processing of your data;

  • 4.1.6. Contact the supervisory authority—the Data State Inspectorate of the Republic of Latvia (or another EU GDPR supervisory authority).

5. Final Provisions

5.1. This Privacy Policy has been developed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation), as well as the effective laws of the Republic of Latvia and the European Union.
5.2. The Data Controller reserves the right to make changes or additions to this Privacy Policy at any time and without prior notice. Amendments take effect after their publication on the website https://avstyle.lv.
